low cost dwelling units for EWS

In Haryana, now the families belonging to Economically Weaker Sections (EWS) of the society having income of Rs three lakh per annum would also be eligible for allotment of low cost dwelling units and Ashiana flats constructed by Haryana Urban Development Authority (HUDA).
     While stating this here today, a spokesman of HUDA said that a proposal to this effect has been approved by Chief Minister Mr Manohar Lal. The Chief Minister has also approved  the revised policy regarding fixing of norms and eligibility for beneficiaries for the allotment of low cost dwelling units constructed by HUDA in various Urban Estates in the State.
          He said that the new policy would govern the conditions for allotment of low cost dwelling units for unauthorized occupants on lands belonging to HUDA, Government of Haryana or any of its agencies in various Urban Estates in the State.
          Referring to the norms and eligibility criteria of allotment to such beneficiaries, he said that first preference for the allotment of low cost dwelling units would be given to the petitioners in CWP No.11637 of 1996 and other connected CWPs in the respective Urban Estates who have been unauthorizedly occupying land belonging to HUDA for the last more than five years as on April 19, 1999, when the matter was decided by the Punjab and Haryana High Court. For this purpose, the cut off date would be April 18, 1994.  
          He said that the second preference would be given to those inhabitants and occupants who have been unauthorizedly occupying the land belonging to HUDA for the last more than five years as on April 3, 2008, when a bunch of cases got finality in the Apex Court. For this purpose, the cut off date would be April 1, 2003. This provision would also include those inhabitants and occupants who are occupying unauthorizedly any land belonging to the Government of Haryana or any of its agencies and also land which affects the essential services like roads, water supply, sewerage, bridges etc. The beneficiaries whose names appear in a valid survey conducted by HUDA and District Administration and are still residing at the same place, may also be considered for such allotment for recovery of land on a cluster basis, he added.
      The spokesman said that thereafter the left out dwelling units might be allotted to the beneficiaries of BPL category of Haryana only. In this category, first preference would be given to BPL families of the city in which dwelling units are constructed, followed by BPL of that District and then BPL families of other Districts of the State. He said that BPL card duly issued by the District Administration or competent authority would be considered as proof of BPL category. Such beneficiary could also avail the benefits of credit linked subsidy scheme under Pradhan Mantri Awas Yojna.
          He said that the next preference for allotment would be given to beneficiaries under EWS category of Haryana only with annual income of upto Rs three lakh or as may be decided by the competent authority from time to time. The applicant under EWS category would submit self certificate or affidavit as proof of Income. But for identity, the applicant may be asked to provide copy of Aadhar card. Such beneficiaries could also avail the benefits of credit linked subsidy scheme under Pradhan Mantri Awas Yojna. He said that the allotment of dwelling unit would be made through draw of lots among eligible beneficiaries as per preference set out above. Quoting example, he said that if number of dwelling units available and number of eligible beneficiaries, say among first preference, are equal or more, then such allotment would be made to the beneficiaries of the first preference only. 
          The spokesman said that a beneficiary family would comprise husband, wife, unmarried sons and or unmarried daughters. The beneficiary family should not own pucca house either in husband’s or wife’s name or in the name of any dependent member of his or her family in Haryana, Chandigarh, Delhi and any other part of India and such beneficiary family should not have been allotted a house, plot by HUDA, Housing Board under EWS, BPL and any other reserved category. He said that if the benefit has been availed once, the beneficiary family would become ineligible for future. Only one application from an eligible beneficiary family would be considered. The attempt on the part of applicant to show more Jhuggies or dwelling units for the sake of availing multiple benefits would be discouraged, he added further.
          He said that the applicant must be a citizen of India and must have attained the age of majority at the time of applying. The application would be accompanied by prescribed fee. In case of submission of false information of any form or nature, the application and in cases where allotment has already been done, would be cancelled and further legal action shall be taken against such applicant. The dwelling units so allotted would not be transferable for a period of 20 years from the date of allotment except in case of death of allottee.
          He said that rates as fixed by the Authority from time to time for dwelling units may be charged under the scheme. If the subsidy is received by HUDA under Jawaharlal Nehru National Urban Renewal Mission (JNNURM), Pradhan Mantri Awas Yojana or any other such scheme, then same would  be passed on to the beneficiary of that project for which subsidy was granted. All the beneficiaries would be required to submit an affidavit as per proforma and documents in support of their claim with the application.
          The Chief Administrator, HUDA, Panchkula would have power and competence to decide or clarify any issue or dispute arising as to the interpretation of any of the clause of this policy and or form or manner of its implementation, he added.
