Employees eligible for ACP scale after chargesheet is dropped

Haryana Finance Department has issued clarification regarding grant of Assured Career Progression.
While stating this here today, a spokesman of the Finance Department said that the employee who was otherwise eligible for grant of ACP scale but was denied the same because of an ongoing departmental inquiry or chargesheet, would become eligible for the ACP scale once the chargesheet is dropped. No impact of the subsequent chargesheet or disciplinary inquiry would be caused in the matter. 
He said that in a communication addressed to all Heads of Departments, they have been advised that similar matters might be dealt with by the Administrative Departments in future. A copy of the clarification can also be viewed at website of the Finance Department www.finhry.gov.in
He said that a decision to this effect was taken following a situation that has been faced by different Administrative Departments in the grant of ACP scales. Under this situation, an employee who was otherwise eligible for grant of ACP scale was denied the same on a date because of an ongoing departmental inquiry or chargesheet. Subsequently, the same employee was cleared from the disciplinary inquiry and chargesheet on another date. However, between these two dates, the employee faced another departmental inquiry or chargesheet which was in the process of second date when he was cleared of the first chargesheet. Therefore, the dilemma faced by the Administrative Department was whether the employee was eligible after the second date, when he was cleared of the first chargesheet, to be granted ACP scale with effect from the date when he was first denied of it, that is when he would originally become eligible or not.
