Services of Group-B employees to be regularised

CHANDIGARH, JUNE 17
Haryana Chief Secretary today issued notification  to regularize the services of  Group-B employees  working  either  on contract  or ad hoc basis.
         Employees completing 3 years as on May 28, 2014 and still in service
 According to the notification, the employee  engaged on contract  basis should have worked for not less than three years as on May 28, 2014 and is still in service.  Similarly, the employee or worker should possess the prescribed qualifications for the post on the date of appointment or engagement and the post against which the regularization is to be done should be a duly sanctioned vacant post at the time of initial appointment or engagement and also at the time of regularization.
          The notification states that “reservation policy issued from time to time might also be kept in view at the time of regularization. In case the roster meant for reserved category is consumed by General or other category the next vacancy would be filled up from the said reserved category or vice versa. The work and conduct of such employee or worker should have been satisfactory adding that the contributory pension scheme would be applicable after regularization of the service, he added. A medical fitness certificate and documentary proof of date of birth as per the instructions would be obtained from the employee or worker concerned. Furthermore, his or her antecedents would be got verified by the Police Department as per the Government instructions, if it was not done earlier. No relaxation in the criteria as laid down above would be allowed”.
          “The regularization of Group-B employees working on contract basis would be with effect from the date of issuance of the notification by the department concerned after adopting the due procedure. Such posts, against which regularization is considered, were required to be taken out of the purview of Haryana Public Service Commission. As such, the concerned departments would be required to complete the process for regularization of services of such employees in consultation with the Haryana Public Service Commission”.
Fixation of Seniority
“The seniority of the employees so regularized would be fixed from the date of their regularization and they would be placed below in the seniority to the employees last appointed on the regular basis before the date of regularization of these employees. However, the inter-se-seniority of such employees would be determined in accordance with the date of their joining the post on contract basis. If the date of joining the post on contract basis of such employees is the same, then the older employee would rank senior to the employee younger in age. Since this policy is a 'one time measure' on humanitarian ground, no person would be entitled to claim it as a matter of right, if found unsuitable due to non fulfillment of the conditions mentioned in these instruction. In future, no illegal or irregular appointment or employment on adhoc or contract would be made against sanctioned posts” the notification added.
          Chief Secretary has made it clear that that the departments might have sent their requisitions to fill up the vacant posts by taking into account the anticipated vacancy and advertisements may have also been issued by the Haryana Public Service Commission and as a result of regularization of such employees, the number of available vacancies in the departments may change and affect the requisitions already sent to Haryana Public Service Commission. The departments have been directed to ascertain that by regularization the service of their employees, whether the number of vacancies requisitioned to HPSC have changed. If yes, the Department concerned would request the Commission within a period of one week to issued corrigendum in this regard.
            Policy regarding regularization of Adhoc Employees
The State Government has decided that only those Group B employees working on adhoc basis whose services could not be regularized vide State Government Policy dated March 7, 1996 due to withdrawal by the State Government vide letter dated December 8, 1997 would be regularized with effect from the date they were eligible as per policy dated March 7, 1996. Other terms and condition of regularization would remain the same. This decision regarding regularization would be applicable to the employees who are presently working with the Government.
